India: Did nobody kill Pehlu Khan?

On the eve of India’s 73rd Independence Day, a travesty of a verdict blotted India’s jurisprudential landscape. Rejecting the weak links in the process of collection of evidence during investigations – which included a video that was not forensically tested by the state’s prosecution, but which clearly could identify the six assailants – an Alwar Court has acquitted all six people accused of the murder of 55 year-old cattle trader, Pehlu Khan. 

Earlier, police had given the accused a clean chit based on statements from the staff of a local cow shelter, and phone records. What police failed to highlight, was that Jagmal Yadav, one of the accused, was also the manager of the cowshed whose employees testified that he and the other accused were present at the cowshed at the time of the crime.

This is arguably one of the most controversial mob lynching cases in the country, not only because the entire dance of death was caught on camera, but also because Pehlu Khan himself was chargesheeted in the case upon allegations of cow smuggling.

    Hindooo Dindoo Vedas allow Cow Slaughter

    gam alabhate; yajno vai gauh; yajnarn eva labhate; atho annam vai gauh; annam evavarundhe. Taittiriya Brahmana, III. 9.8.2-3 (Anandasramasanskritgranthavalih 37, vol. Ill,3rd.edn., Poona, 1979).

    (At the horse-sacrifice) he (the Adhvaryu) seizes (binds) the cow (i.e. cows).
    The cow is the sacrifice. (Consequently) it is the sacrifice he (the Sacrificer) thus obtains.
    And the cow certainly is food. (Consequently) it is food he thus obtains.’

    Cow’s Urine

    Cow’s urine "gomutra" is prescribed as an ingredient of various plasters and mixtures (sometimes with fermented wine) or alone, as an antidote for obesity, as a purgative; for eliminating vermin from an ulcer; vayu disorders, abdominal dropsy and many other uses. [ Su. 15.35; 44.35 ] [ Ci 1.87; 14.13 ] [ Ray 131 ] Bitumen and cow’s urine is taken internally to cure malignant jaundice. [ Utt. 44.29 ] [ Ray 234 ]. Antimony sulfide and cow’s urine taken internally is also used to cure malignant jaundice. [ Utt. 44.29 ] [ Ray 234 ]. For the case of sebaceous cysts (large swellings that exude a fatty liquid on bursting), incision followed by washing with cow’s urine is prescribed. Another treatment is the surgical incision and the removal of fat followed by cauterization of the wound [ Ci.18.10-11 ] [ Ray 295 ].

    Goat Dung and Urine

    Goat droppings "ajashakrt" are prescribed as an accessory to surgical cauterization and is used for cauterizing diseased skin. In powdered form after drying and compounding with honey and cow’s urine it is used as a linctus for jaundice. [ Su 12.3 ] [ Utt.44.19 ] [Ray 130 ] Goat urine "ajamutra" is an ingredient for a paste that restores the natural colour to a cicatrix. [ Ci.I.86 ] [ Ray 130 ]

    Elephant Urine

    Elephant urine "gajamutra" is used as an alkaline decoction preparation for a supposed cure to malignant sores. [ Ci.9.16 ] [ Ray 131 ]

    Cock Dung and other Birds’ Droppings

    The dung of a specially fed cock "kukkutapurisha" is prescribed as an ingredient for a plaster used to cure malignant skin diseases [ Ci.9.15 ] [ Ray 132 ] Vulture droppings "grdhrapurisha" is an ingredient of a plaster fro bursting of non-boils [ Su.37.9 ] [ Ray 132 ]. A similar use exists for pigeon droppings "karikapurisha" and heron droppings "kapotapurisha" [ Su.37.9 ] [ Ray 132 ]. The hooves of animals are powdered and after burning restore the darkness to a cicatrix; a paste of the powder obtained by burning is a cure for baldness [ Ray 132 ] Animal horns are used as surgical instruments and the paste is aid to be a cure for baldness. [ Ray 133 [ [ Ray 110 ff ] meat of various kinds is good The urine of different animals is recommended for use as purifying and appetizing agents; for cardiac stimulants and many others. Each type of urine has special advantages

    SAHIH MUSSIM – Bk 7, Number 3029:

    Jaibir b. ‘Abdullah (Allah be pleased with them) reported: We performed Hajj Tamattu’ along with Allah’s Messenger (may peace be upon him) and we slaughtered a cow on behalf of seven persons sharing in it.

    SAHIH MUSLIM – Bk 7, Number 3030:

    Jabir reported that Allah’s Messenger (may peace be upon him) sacrificed a cow on behalf of ‘A’isha on the Day of Nahr (10th of Dhu’l-Hijja).

    SAHIH MUSLIM – Bk 7, Number 3031:

    Jabir b. ‘Abdullah (Allah be pleased with them) reported that Allah’s Messenger (may peace be upon him) sacrificed (animals) on behalf of his wives, and in the hadith transmitted by Ibn Abu Bakr (the words are):" A cow on behalf of ‘A’isha on the occasion of the Hajj."

    SAHIH BUKHARI HADEETH – Volume 2, Book 26, Number 778:


    Narrated ‘Amra:

    I heard ‘Aisha saying, " When we approached Mecca, Allah’s Apostle ordered those who had no Hadi along with them to finish the lhram after performing Tawaf of the Ka’ba, (Safa and Marwa). ‘Aisha added, "Beef was brought to us on the Day of Nahr and I said, ‘What is this?’ Somebody said, ‘The Prophet has slaughtered (cows) on behalf of his wives.’ "

    SAHIH BUKHARI HADEETH – Volume 4, Book 52, Number 322:

    Narrated Muharib bin Dithar:

    Jabir bin ‘Abdullah said, "When Allah’s Apostle arrived at Medina, he slaughtered a camel or a cow." Jabir added, "The Prophet bought a camel from me for two Uqiyas (of gold) and one or two Dirhams. When he reached Sirar, he ordered that a cow be slaughtered and they ate its meat.
